Update: On July 11, 2023, at 4:00 p.m. the Court held a Fairness Hearing at the United States District Court Southern District of New York, before the Honorable John G. Koeltl. At this hearing the Court held that the Settlement is fair, reasonable, and adequate and signed the Order granting the final approval of the Settlement. To download a copy of the Final Approval Order, click here.

The first round of payments will be issued in late September 2023 to class members who filed valid claims. If your claim was not validated in the first round, please be patient. There will be subsequent waves of payments. To check the status of your claim, please call the Settlement Administrator at 833-472-1994.

Important: ONLY FOR THOSE RECEIVING NEEDS-BASED GOVERNMENT BENEFITS WITH RESOURCE/INCOME LIMITS (EX. SSI and/or Medicaid, BUT NOT SSDI and/or Medicare): You should deposit/cash your check early in the month to allow time to Spend Down below that limit by the end of the month that your check was cashed. You also need to report and provide proof that funds were spent on you and for your needs to the relevant agency after spending down the funds.

A Settlement has been reached with the City of New York to resolve claims in a lawsuit.  The lawsuit claims the City of New York violated the law when it delayed releasing people after their bail was paid.  The City of New York denies it did anything wrong. 

Generally, the Settlement includes individuals (also called Class Members) in the custody of the New York Department of Corrections, who were released on bail at least once between October 4, 2014 and October 21, 2022, who reasonably believe their release may have been delayed at least 3 hours after their bail was paid.

The Settlement will pay money to eligible Class Members, the costs of notice and administration, special service awards to the Class Representatives, and attorneys’ fees and costs.
